Terms of ServiceTerms of Service

Article 1: General Provisions
  • ① The Terms of Service for the Biological Resource Center (Korean Collection for Type Cultures), hereinafter referred to as "these Terms," serve the purpose of outlining the rights, obligations, and responsibilities of the user and the KCTC (Biological Resource Center), hereinafter referred to as "KCTC," in relation to the internet-related services ("Services") provided by KCTC.
  • ② An individual who wishes to become a user is considered to have agreed to these Terms once they have followed the procedures set by the KCTC and clicked on the "Confirm" button.
Article 2: Definition of User

① A "user" refers to the individual who receives the services provided by this site in accordance with these Terms.

Article 3: Membership Registration
  • ① An individual who wishes to become a user must apply for membership registration by filling out their member information according to the form set by the "KCTC" and clicking the "Confirm" button.
  • ② "KCTC" shall register the applicant as a member unless the applicant who applied for membership in the manner stated in the first paragraph falls under any of the following categories.
  • ③ The membership agreement comes into effect when the "KCTC" approval reaches the membership applicant.
  • ④ Members must immediately correct and update their member information in the event of any changes to the information provided as per Paragraph 1.
Article 4: Provision and Modification of Services

"KCTC" provides the following services to the user.

  • 1. Services related to "Distribution"
  • 2. Services related to "Deposit"
  • 3. Services related to "Information Services"
  • 4. Services related to "Biodiversity"
  • 5. Services related to "Research Support"
  • 6. Services related to "Community"
  • 7. All other services that "KCTC" develops or provides to its members through collaboration agreements with other organizations, etc.
Article 5: Service Suspension
  • ① "KCTC" may temporarily suspend the provision of services in the event of maintenance, replacement or malfunction of information communication equipment such as computers, or interruption of communication. Furthermore, "KCTC" reserves the right to completely discontinue the currently provided services based on reasons deemed appropriate by "KCTC", such as a transition to new services.
  • ② In the case of service interruption according to Paragraph 1, "KCTC" will announce the interruption date and reason on the site's main page from seven days before the interruption until the date of interruption. However, this does not apply when prior notice is impossible due to reasons beyond "KCTC"'s control, such as service interruptions due to unavoidable circumstances (e.g., disk failure or system downtime with no deliberate action or negligence from the system administrator).
Article 6: User Withdrawal and Loss of Qualification, etc.
  • ① A user can request to "KCTC" at any time to delete their membership registration (withdraw from membership), and upon receipt of such request, "KCTC" will immediately commence procedures to delete the user's membership registration.
  • ② In the event that a user falls under any of the following reasons, "KCTC" can limit, suspend, or revoke the user's membership rights using appropriate measures.

      1. When an application is made using another person's name.
      2. When the contents of the membership application form have been falsely stated or applied.
      3. When applying with the intent to harm social order or public morals.
      4. When engaging in behavior that interferes with another person's use of this site's services, or stealing such information.
      5. When using this site to engage in actions prohibited by laws and these terms and conditions.
      6. When other membership requirements set by the site are not met.

Article 7: Notification to Users
  • ① When KCTC needs to give notice to a specific user, it can do so by sending an email to the address provided by the user at the time of registration (only if the user has agreed to receive emails).
  • ② When KCTC needs to send an SMS notification to a specific user, it can do so by sending a message to the mobile phone number provided by the user at the time of registration (only if the user has agreed to receive SMS messages).
  • ③ If KCTC needs to notify an unspecified number of users, it can do so by posting the notification on the KCTC bulletin board, which can replace individual notifications.
Article 8: Protection of User's Personal Information
  • KCTC strives to protect the personal information of users, including user registration information, in accordance with relevant laws. The protection of user's personal information is governed by relevant laws and the 'Privacy Policy' established by KCTC
Article 9: Duties of KCTC
  • ① KCTC commits to refraining from any actions that violate the law or this Agreement, or that run contrary to public morals and decency. KCTC will make consistent and reliable efforts to provide services in accordance with this Agreement.
  • ② KCTC is responsible for establishing a security system to ensure the safe use of internet services by users and to protect users' personal information, including credit information.
  • ③ KCTC will not send commercial advertising emails that are unwanted by the user.
Article 10: User's Duties Regarding ID and Password
  • ① "KCTC" is responsible for the management of the user's ID and password, except when required by related laws or the "Privacy Policy".
  • ② Users should not allow their ID and password to be used by third parties.
  • ③ If a user notices that their ID or password has been stolen or is being used by a third party, they should immediately notify "KCTC", and follow any instructions given by "KCTC".
Article 11: Duties of the User
  • ① Users shall not engage in the following actions:
    • 1. Providing false information during membership registration or modification.
    • 2. Modifying information posted by "KCTC".
    • 3. Infringing upon the personality rights or intellectual property rights of "KCTC" or third parties, or obstructing business operations.
    • 4. Impersonating another member's ID.
    • 5. Sending junk mail, spam mail, chain letters, or any other emails containing obscene, violent, or offensive content, or disclosing/posting information that violates public morals.
    • 6. Transmitting or posting information (such as computer programs) that is prohibited by relevant laws from being transmitted or posted.
    • 7. Posting or sending messages in someone else's name.
    • 8. Posting or emailing materials containing computer viruses, software, hardware, or any other computer code, file, or program designed to disrupt or destroy the normal operation of computer software, hardware, or electronic communication equipment.
    • 9. Engaging in stalking or any other behavior that harasses other users.
    • 10. Collecting, storing, or disclosing personal information of other users without their consent.
    • 11. Violating the terms and conditions or any other regulations regarding the use of services provided by "KCTC".
  • ② If a user engages in actions described in Paragraph 1, "KCTC" may restrict, suspend, or terminate the user's membership in an appropriate manner.
  • ③ Users shall be responsible for compensating any damages incurred by "KCTC" or other users due to their own actions.
Article 12: Deletion of Public Posts
  • If the content of a user's public post falls under any of the following, "KCTC" may delete the post without prior notice and restrict, suspend, or terminate the user's membership:
  • 1. Content that defames or damages the reputation of other users or third parties through slanderous or malicious allegations.
  • 2. Content that disseminates information, sentences, images, or other materials that violate public morals.
  • 3. Content that is determined to be related to criminal activities.
  • 4. Content that infringes upon the copyrights or other rights of other users or third parties.
  • 5. Other content that is deemed to be in violation of relevant laws.
Article 13: Ownership of Copyright and Usage Restrictions
  • ① The copyrights and other intellectual property rights of the works created by "KCTC" belong to "KCTC".
  • ② Users shall not reproduce, transmit, publish, distribute, broadcast, or otherwise utilize the information obtained through the use of "KCTC" for profit or provide it to third parties without prior consent from "KCTC".
Article 14: Jurisdiction
  • ① Any disputes arising from the use of services between "KCTC" and users shall be governed by the laws of the Republic of Korea, and any lawsuits arising from such disputes shall be filed with the courts of the Republic of Korea, which have jurisdiction under the Civil Procedure Act.

Supplementary Provision (Effective Date) This Agreement shall come into effect on November 1, 2003.

Use of Personal Information According to Processing Purposes

Article 1 (Purpose of Personal Information Processing)
• Individuals have the right to refuse to provide personal information. However, if personal information is not provided, there may be disadvantages such as being unable to use events and services provided by the Korean Collection for Type Cultures (KCTC).

1) KCTC processes personal information for the following purposes. The processed personal information will not be used for any purposes other than those stated, and in case the purpose of use is changed, necessary measures will be taken in accordance with Article 18 of the Personal Information Protection Act to obtain separate consent.

2) The purposes of processing personal information files registered and disclosed by KCTC in accordance with Article 32 of the Personal Information Protection Act are as follows:

Processing and Retention Period of Personal Information

Article 2 (Processing and Retention Period of Personal Information)

The Korean Collection for Type Cultures (KCTC) processes and retains personal information within the period specified by applicable laws or the consent obtained from the data subject at the time of data collection.

The processing and retention periods for each category of personal information are as follows:

  • - Records related to contracts or subscription withdrawals
    • Retention reason: Consumer Protection Act in Electronic Commerce
    • Retention period: 2 years
  • - Records related to payment of fees and supply of goods
    • Retention reason: Consumer Protection Act in Electronic Commerce
    • Retention period: 2 years
  • - Records related to electronic financial transactions
    • Retention reason: Electronic Financial Transactions Act
    • Retention period: 2 years
  • - Records related to consumer complaints or dispute resolution
    • Retention reason: Consumer Protection Act in Electronic Commerce
    • Retention period: 3 years
  • - Service usage records related to website membership registration
    • Retention reason: Initial website registration and last login
    • Retention period: 2 years
Article 7 (Installation, Operation, and Rejection of Automatic Collection Devices for Personal Information)

The KCTC website uses 'cookies' to store and retrieve usage information to provide individualized customized services to users.
Cookies are small pieces of information sent by the server (http) operating the website to the user's computer browser, and they may be stored on the hard drive of users' PC computers.

Purpose of using cookies: Cookies are used to provide optimized information and enable users to set frequently visited services.
Installation, operation, and rejection of cookies: Users can reject cookie storage by adjusting the options in the Tools > Internet Options > Privacy menu of their web browser.
If you reject cookie storage, it may cause difficulties in using personalized services.
